Indemnity form

I have been thinking about this a little lately. I have been to a few events held by the club and have only signed a few indemnity forms and all were from the venues which to me means that they (the venue) are cleared of all incidents and/or damage that may occur. Should we as a club not also have an indemnity form protecting the club? My apologies for raising this if there is something in place. If there is, please direct me to where I am able to download it so we can use it at our events. I am not trying to be an events coordinator or something but I am trying to assist where I can.

There is another way of doing it....
If there is a Indemnity form for the club then i could be signed to cover any and all club events

This form could be signed once a year at the same time as the club fees are due...
All new members would then have to sign it to.....

We do use indemnity forms in the Cape.

Good idea. Although the down side is we are heading down a total SHERQ system for the club.

I've actually completed and indemnity for each trail we have driven this year. For that matter, if you just let me sign without explaining and training me on the risks your indemnity is worthless. To be thorough you need to follow the mining processes and you need to have me attend induction with proper training on all the risks that we might encouter and ensure that I understand that before you can issue me with a valid indemnity.

After that, still a good idea.

Cassie, laai gou daai een wat ek gister vir jou gemail het? That is the one the AAWDC uses for their fun days. I just modified it as far as names etc goes. This is also the one we used at Tierkloof.

Either one would be correct..

So what you saying is before each course there has to be a training session??
Shew That could take time for each person to go through it.....
So we cant have a general Indemnity form signed by all members?

I dont think that is what Heinrich meant exactly. But there is a Pre Trail Diver's Briefing (Safety Standards) that the group leader discusses with the group beforehand. This can be found here: viewtopic.php?f=63&t=1526" onclick="window.open(this.href);return false;

It is also a good idea that every person who attends a GTG familiarises him/herself with these safety standards, and that he/she revisits it from time to time, as it is updated as the need arises. That way we dont have to go into lengthy "training" sessions beforehand. It was mentioned on another discussion a while ago that there should be a tick-box on the Indemnity form where the participant can tick to indicate that he has read and understood the safety standards document.

I would beg to differ. If the attendee signs to the effect that he / she assumes all his / her own risks, that's the end of it. The attendees are not forced to take part and can opt out at any time if there is an obstacle that is beyond their capabilities. They are there of their own free will and they assume responsibility for their actions. Any advice / instruction or assistance from a safety officer, event co-ordinator, fellow attendee is just that and is to be assessed by the driver himself, if he disagrees he can discuss his reasons or even opt out. If you are told to drive off a cliff, would you?

Instead of the tick-box, on web forms we add the clause "I ___________ , the undersigned, understand and accept these terms and conditions."

Obviously the signature below then makes the doc binding. The __________ is usually used for the person's printed name & surname, but is optional.

Is it the responsibility of the club to ensure that detailed training is provided to all attending participants prior to the actual start of the event?
I am looking at this from a personal point of view. I mean when I first joined the forum and started attending events I had no idea of what the rules and so on were. I was thinking should something happen then I would take responsibility for my own actions. After reading about some incidents on other forums I realized that not all think more or less the same as me and would, should something happen hold the club liable. I have been reading about indemnity forms and I find that no official training is required BUT must be explained to the individual who is signing the document and make sure they understand fully. It is a sort of a contract between an individual and another individual whether it be a club/business entity and so on. I can see no need to have to do a full on training session. I do see the need for a driver briefing prior to the start of an event where all safety issues and so are discussed as well as a brief description of what the indemnity for consists of and entails. That should be adequate to make the document legally binding.

You can make it as complicated as you wish Francisco, but a briefing beforehand is sufficient.
