Forced to pay at roadblock? Then sue!

Post by pietpetoors »

The Justice Project SA has called for motorists who had been forced to pay traffic fines at roadblocks to lodge civil claims against the Joburg metro police department.

“JPSA encourages members of the public who have been forced to pay these fines under threat of arrest to institute civil litigation against the JMPD for unlawful arrest and would be happy to assist members of the public to institute such action,” said JPSA chairman Howard Dembovsky.

The call comes after Transport Minister Ben Martins admitted in his response to a parliamentary question that the Aarto Act did not provide for motorists with outstanding penalties to be arrested.

On Wednesday, the Business Day newspaper reported that Martins confirmed that traffic fines could not be delivered by ordinary mail, according to the Aarto Act.

Martins also said Act did not provide for motorists to be arrested for outstanding penalties, the newspaper reported.

Martins was answering a parliamentary question asked by Freedom Front Plus MP Anton Alberts on Tuesday.

Yup, and you can all take heed from the advice. Had a good 'ol chinwag with a "senior official" in the Metro this week. JHB Metro is on the verge of bankruptcy due to the massive amounts of unpaid municipal bills (But we all know it's more to do with corruption and their incompetence).

Metro is cutting water and electricity to homes in an effort to collect enough money to pay their salaries at the end of this month. It is completely illegal to cut water, but they don't care. Caught a guy this week trying to cut my water as I came home. Worst part is he was at the wrong address - he was in the wrong street and at the wrong number!

These idiots who run our country just don't care about laws or court rulings. They do whatever they want!

Driving in convoy during weekend - R500.00
So does that include us when we go on a 4x4 day, meet somewhere and drive in a convoy?
On a technical note, when does the weekend start according to the road traffic act?

Piet convoy driving is for "larger groups", cant remember the exact number of hand.

I know it applies to large group of motorcyclists - any person that have had the displeasure to get caught behind a string of Harleys will appreciate this ....

so driving in convoy becomes applicable when you block the road for others ....

I had the displeasure of driving behind a small convoy of street racers this weekend coming back from langebaan.
There was drag racing in Saldanha, and unfortunately, the racers left the same time we headed home.
after making an almighty racket at the OneStop, revving their cars like petrol was going out of fashion, they left just before us.

I caught up with their convoy of about 7 cars and two vans with trailers leading the pack, cruising along at 100kph.
They were so tightly bunched you had no choice, but to find a clear stretch and floor it past all of them.
Now I can see why the no convoy rule is for, for idiots like this.
